Why King files there
Small Claims Court venue runs by territorial division, not by city. A territorial division is a county, a district, or a regional municipality, plus nine single-tier cities such as Toronto, Ottawa, and Hamilton (rule 1.02(1)).
King is a lower-tier municipality inside the Regional Municipality of York (O. Reg. 180/03, Schedule 1). The court sits at Newmarket or Richmond Hill for the whole division, so a King claim is filed there.

- Where is the Small Claims Court for King?

- Do I have to file my claim at Newmarket or Richmond Hill?
- Not always. Under rule 6.01 you start the action in the territorial division where the cause of action arose, or where any defendant lives or carries on business, or at the court's sitting place nearest to a defendant (O. Reg. 258/98, r. 6.01(1)). If the money is owed to you in King and the defendant is also in York, Newmarket or Richmond Hill is the court. If the defendant lives or does business somewhere else, that place can be the venue instead.
- Can I file a King claim online?
- Yes. Outside Toronto, claims are filed through Small Claims Court Submissions Online (rule 1.05.4, in force October 14, 2025). Staff review a submission within 3 business days. A writ of seizure and sale of land (Form 20D) cannot be filed online. The filing fee is $108 for an infrequent claimant, $228 for a frequent claimant (O. Reg. 332/16, as stored 2026-01-06).
- What is the Small Claims Court limit for King?
- The same as everywhere in Ontario: $50,000, not counting interest and costs (Courts of Justice Act s. 23; O. Reg. 626/00 s. 1, as amended by O. Reg. 42/25, in force October 1, 2025). A claim cannot be split into two to fit under the limit (rule 6.02).
- How long do I have to sue in King?
- In most cases, 2 years from the day you discovered the claim (Limitations Act, 2002, s. 4 and s. 5). After the claim is issued, you have 6 months to serve it (rule 8.01(2)); the defendant then has 20 days to file a Defence (rule 9.01).
