Form 1A: Additional Parties

Form 1A is the Additional Parties page for a claim in the Ontario Small Claims Court. You attach it to Form 7A or Form 10A when the claim has more parties than the main form holds [VERIFY rule 7/10 pinpoint]. The form has 3 party blocks, and each block holds one more plaintiff or one more defendant (Form 1A). Use a second Form 1A when you have more than 3 parties to add (Form 1A).

When you use it

  • • Use it when your claim names 2 or more plaintiffs or 2 or more defendants (Form 7A; Form 10A).
  • • Use it with Form 10A when you claim against the plaintiff and another person at the same time (rule 10.01).
  • • Name each party on it by its full legal name and its capacity (rule 7.01(2)).
  • • Serve the whole claim, with Form 1A attached, on each defendant within 6 months of issue (rule 8.01(2)).

How to complete and file Form 1A

  1. 01

    Enter every plaintiff and every defendant in the Form 7A or Form 10A interview.

  2. 02

    Check each party's full legal name and capacity, for example a corporation or a sole proprietor (rule 7.01(2)).

  3. 03

    Tick the box on the main form that says more parties are listed on Form 1A (Form 7A; Form 10A).

  4. 04

    Leave the claim number blank on a new claim, because the clerk assigns it at issue (Form 1A).

  5. 05

    File the claim and Form 1A as one document (rule 1.05.4; rule 1.05.5).

  6. 06

    Serve the issued claim, with Form 1A, on each defendant within 6 months (rule 8.01(2)).

Questions people ask about Form 1A

Do I need Form 1A if I sue only one person?
No. Form 7A holds 1 plaintiff and 1 defendant (Form 7A). You need Form 1A only when the claim has a second plaintiff or a second defendant, for example a company and its owner (Form 1A). The free Form 7A interview adds the page for you when you enter a second party. The same applies to a Defendant's Claim on Form 10A (Form 10A).
How do I number the parties on Form 1A?
The plaintiff and the defendant on the main form are each No. 1 (Form 7A). The first party on Form 1A is No. 2 for its side, the next is No. 3, and so on (Form 1A). Tick one role box in each block, and write the number in the box for that role (Form 1A). Leave the other role's box empty. The free interview does this for you.
Can I sue a company and its owner on the same claim?
You can name more than one defendant on one claim when the claim against each arises from the same facts [VERIFY]. Put the second defendant on Form 1A (Form 1A). Name a corporation by its exact legal name, and a person by their full name (rule 7.01(2)).
